Legacy Planning: The What, Why & How

Legacy planning, also known as estate planning, is when you decide how your money and your assets should be distributed after you pass away. Your legacy plan is created with the help of an attorney and certified as a binding legal document so that once you pass away, your wishes will be carried out. 

We understand that no one wants to think about passing away, especially when children are involved. However, if you’re an older adult and don’t yet have an up-to-date will or legacy plan, we strongly recommend speaking with an estate planning attorney soon to create one. Unfortunately, accidents and illnesses can happen to any of us at any time, and you don’t want your family to be left without instructions after your death. Passing away without a will can cause tension, frustration, arguments, and major rifts among your family and leave the distribution of your assets up to the state. What Is Legacy Planning?

Creating a will or estate plan is not solely about divvying up your assets. We like to use the term “legacy planning” because the process also involves discussing core values, how you want to impact the lives of your children or heirs, and, often, a community or charitable cause close to your heart. 

Why Is Legacy Planning Important?

It’s very important that you leave behind instructions for what to do with your assets after you’re no longer here. It doesn’t matter what your family structure is like, if you have kids or no kids, or if you aren’t wealthy. Distributing assets after death can easily become a complicated process that takes months, or even years, to resolve in probate. 

Many people are under the impression that only wealthy people need legacy plans, but this isn’t true. Everyone can benefit from having a legacy plan, especially if you have loved ones you’d like to leave things to. 

How to Start Legacy Planning

Here are questions to ask yourself when starting the legacy planning process:

  • What assets do I have?
  • What is their total worth?
  • Who do I want to receive each asset?
  • Do I want to leave a personalized note along with each asset?
  • Do I want to leave any assets or money to charity?
  • Who do I want to be in charge of my assets if I become incapacitated and am not able to make decisions myself?

After you’ve gathered the answers to these questions, contact a local estate planning attorney and work with them to turn your answers into legal documentation. Once your legacy plan is official, it’s important to review it on a regular basis and ensure any changes are reflected. You don’t want to stick it away in a drawer and forget about it for years and years. Keep it updated and keep it current. 

Tips for Legacy Planning

  • Work with a lawyer who specializes in legacy planning. Don’t fall victim to the “create your own estate plan” websites, because their legality is often contested. Instead, use those tools or guides as a starting point to help you get your thoughts down on paper.
  • Keep your lawyer updated on any changes to your estate. For example, if you buy a new house, open a new business, divorce or remarry, buy a new car, or make changes to your investment portfolio, your estate planning lawyer needs to know.
  • Don’t put it off! Legacy planning often goes on the list of things you’ll eventually get around to, but we recommend getting your legal affairs in order as soon as you can.

Seniors, Stay Hydrated!

We are happy to say summer is here at our shoreside senior community! As we enjoy these beautiful days in the hot summer sun, it’s crucial for seniors to stay hydrated. It’s amazing what drinking a little water can do for your overall health – and equally amazing how so many of us forget to do this. In this article, our senior caregivers in South Jersey will highlight four major reasons why it’s important for seniors to keep up with their water intake during the summer and all year round.

Dehydration

While this reason for staying hydrated seems incredibly obvious, we still need to address it. Being dehydrated can actually make you feel sick, and sometimes medical attention is needed to recover properly. Some symptoms you might experience while dehydrated are fatigue, dizziness, headaches, muscle cramps, rapid heart rate, low blood pressure, dry mouth, and confusion.

Kidney Function

As seniors age, their kidney function often declines.  A period of extended dehydration can cause severe damage to your kidneys. Our kidneys are responsible for filtering out toxins in your bloodstream, and if they aren’t working properly, toxins and electrolytes become unbalanced and build up. In severe cases, this imbalance can cause serious illness or death. Because seniors often lose the sensation of thirst, it’s important that they intentionally drink water throughout the day even, when they aren’t thirsty.

Digestion

Hydration is the key to digestive health, and if you aren’t staying hydrated it can lead to constipation, gastric reflux, and acid reflux. Drinking water produces an acid that helps your body break down food. If you’re not drinking enough water, your body can’t properly absorb the nutrients in your food. Drinking a glass of water before and after a meal is a great way to stay hydrated and make it easier to digest your meal.

Brain Function

Our brains and bodies are mainly composed of water, which is why water is crucial for brain function. While it is normal for our mental processes to slow as we age, we don’t want to accelerate it by depriving our brain and body of the water it needs. Cognitive function is enhanced when the brain cells receive appropriate hydration. “When we become dehydrated, even the tiniest bit, our brain has difficulty functioning, often leaving us confused and forgetful. Furthermore, prolonged dehydration in older adults causes brain cells to actually shrink. This has been linked to a symptom of the onset of dementia and Alzheimer’s.”[1]

How Estate Planning Can Help You Afford Assisted Living

While many folks think estate planning is for the rich or the dying, it’s actually benefits everyone of all asset and income levels, whether you have one child or many, and it’s best done well before you actually need it Estate planning can be especially beneficial if you think you may want or need services from a senior community in the future.

It turns out that a well thought-out estate plan, executed well before you move to a community, can prepare your assets in a way that leaves more money to your family and gives less money to the government, while providing enough resources for you to enjoy a full and carefree life in a senior community. A revocable living trust can also protect a senior client’s financial assets by the appointment of a younger trustee, usually the client’s adult child. This arrangement protects vulnerable seniors from scam artists who steal hundreds of thousands of dollars from the elderly. Under such an arrangement, the elderly client would need the approval and consent of the trustee to make large expenditures of money, thereby thwarting the scammers’ efforts. Online and phone scams are on the rise, and the people behind them are becoming even more clever. That being said, incorporating a Revocable Living Trust can help you save money that can be allocated towards your assisted living plan.

An experienced estate attorney will often recommend that his clients obtain long-term-care (LTC) insurance which can be used to pay for their stay in a Continuing Care Retirement Community (CCRC). Many clients are reluctant to purchase an expensive long-term-care policy that they may never use. In such a case, an elder law attorney might recommend the purchase of a whole life insurance policy with a long-term-care rider. “People become fatigued by paying the LTC insurance premiums which can only be used for Long Term Care, but a Whole Life policy has both a death benefit and can contain a rider which will enable the client to convert a portion of the policy’s death benefit to pay for long-term care in a CCRC if needed.”

What Is Sundowning Exactly?

If your senior loved one has been diagnosed with dementia, you may notice that they experience certain increases in strange or erratic behaviors when the sun starts to set, including trouble sleeping that can last well into the night. This phenomenon is called sundowning, and it can be a confusing time for both you as a caregiver and your loved one. In this article, our Tapestries memory care team in NJ we’ll discuss symptoms, causes, and how you can help prevent sundowning. 

Sundowning in Dementia and Alzheimer’s Disease

The Alzheimer’s Association defines sundowning as “increased confusion that people living with Alzheimer’s and dementia may experience from dusk through the night.” It’s not a disease or a condition itself, rather it’s a set of behaviors that can sometimes accompany dementia diagnoses. 

Sundowning can be very frustrating for both the person with dementia and their caregiver, however it is possible to manage it in order to reduce the impact. 

Common Symptoms of Sundowning

  • Agitation: Dementia often makes people feel agitated, and feelings of agitation can increase when the sun begins to set. 
  • Restlessness: Your loved one may be more restless than usual at dusk.
  • Irritability: If you’ve noticed your loved one acting irritable around sundown, this may be why.
  • Confusion: People with dementia typically become confused at certain points throughout the day, however it can increase when someone is sundowning.
  • Disorientation: A person who is sundowning might appear more disoriented than usual in the evening.

What Causes Sundowning?

While there is no exact known cause, doctors believe that certain factors can contribute to sundowning, including:

  • Being overstimulated by their environment. If your loved one is in an environment where there is a lot of noise, movement, and general overstimulation, this may contribute to the likelihood that they will experience sundowning.
  • Not having a consistent sleeping schedule. Dementia can disrupt a person’s sleep cycle.
  • Being fatigued at the end of the day after doing too many activities. Older adults with dementia generally don’t have the energy for a full day of activities like younger people often do.
  • Changing light when the sun begins to set. Things like shadows and less light in the room can cause your loved one to become confused and act out. 

How to Prevent Sundowning

Unfortunately, there is no way to completely prevent sundowning from happening, but there are ways to manage your loved one’s day-to-day routine and their environment in order to reduce the likelihood that they will experience sundowning:

  • Create and maintain a calm environment. Overstimulation from too much noise and too much activity can have a negative effect on your loved one’s health. Turn off the loud TV when evening is approaching and play some calm, soothing music instead. Visitors should come over to visit your loved one in the late morning or early afternoon. 
  • Exercise regularly. As we get older, it’s essential that we keep up with some form of exercise, even if it’s going for a short walk every day. People with dementia can often feel anxious and agitated, and exercise is a great way to release those feelings. 
  • Maintain structure in your loved one’s day. We’re all creatures of habit and having a solid routine is beneficial for all of us, especially people with dementia.
